The majority of tribunal claims are settled before hearing, which indicates that he was either very stubborn and ignored legal advice, or that he wasn't as innocent as it seems.

Other factors at play would be if he had previous warning for his conduct and if he indicated that he would behave in exactly the same way if a similar situation was to arise.

I see echoes of Tony Martin - surround yourself with people who tell you you're in the right and no jury would convict, then refuse any compromise because you're right.
